These Terms of Service ("Terms") govern your use of Baby Name Generator ("we", "us", "our") at babynamespot.com (the "Service"), operated by Xtrathin Tech lab based in India. By accessing or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old (or 16 where local law requires) to use the Service. If you're under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian. By using the Service, you confirm that you meet these requirements.

2. Your Account

• You're responsible for keeping your password confidential.
• You're responsible for all activity that happens under your account.
• Tell us immediately at support@babynamespot.com if you suspect unauthorized access.
• You can use the name generator without an account; an account is only required for saving and publishing Loved Names lists.
• We may suspend or close accounts that violate these Terms.

3. Acceptable Use

When using the Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Post or publish content that is hateful, harassing, threatening, defamatory, obscene, sexually explicit, or invades anyone's privacy.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Attempt to scrape, crawl, or harvest data from the Service except via permitted public RSS/sitemap files, or to use automated means to create accounts or generate spammy content.
• Interfere with the Service's operation, attempt to bypass rate limits, reverse-engineer the code, or probe for security vulnerabilities (other than via responsible disclosure to us).
• Upload malware, viruses, or other harmful code.
• Use the Service to send unsolicited messages or to harass other users.
• Resell, sublicense, or commercially exploit the Service without our prior written permission.

4. User Content

4.1 What counts as User Content

Anything you submit, post, or publish on the Service — names you save, list titles you create, comments, votes, feedback emails — is "User Content."

4.2 You own your content; you license it to us

You retain ownership of your User Content. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating and improving the Service. For content you publish publicly (e.g. a published Loved Names list), this license extends to displaying it to other users.

4.3 You're responsible for what you post

You represent that you have the rights to post your User Content and that it doesn't violate anyone's rights or these Terms. We may remove or hide any User Content that violates these Terms or that we believe could harm the Service or its users.

5. Our Intellectual Property

The Service — including the design, code, name database curation, logos, and branding — is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written permission, except as permitted by these Terms or applicable law (e.g. fair use).

6. Disclaimers — Please Read Carefully

6.1 Name meanings and origins

Name meanings, origins, and cultural notes are compiled from publicly available sources and may not be 100% accurate or complete. Use them as a starting point, not an authoritative reference. If you spot an error, please email us.

6.2 Astrology, Moon Sign, and Nakshatra

Astrology insights (Moon Sign / Rashi, Nakshatra, Pada) are provided for cultural and entertainment purposes only. They are estimates based on the birth date and time you enter and traditional astrological calculations. They are not medical, religious, or professional advice. We make no claim that they are accurate predictions or guidance for life decisions.

6.3 No medical, legal, or professional advice

Nothing on the Service is medical, legal, financial, or professional advice. Naming a child is a personal decision; consult appropriate professionals (or your family, religious advisor, etc.) where relevant.

7. Limitation of Liability

To the maximum extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
• Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 50.

Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.

9. Advertising

The Service is supported by advertising. We display ads through partners such as Google AdSense. The presence of an ad does not imply endorsement by us of the advertiser, its products, or its services. Your dealings with advertisers are solely between you and them.

10. Third-Party Links and Services

The Service may include links to third-party websites or services we don't control. We are not responsible for the content or practices of those third parties. Their terms and privacy policies apply when you use them.

11. Termination

You can stop using the Service at any time, and you can delete your account by emailing support@babynamespot.com. We may suspend or terminate your access at any time, with or without notice, if we believe you've violated these Terms or if we need to for legal or security reasons. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability) will survive.

12. Changes to the Service or These Terms

We may change, suspend, or discontinue parts of the Service at any time. We may also update these Terms — when we do, we'll change the "Last updated" date and, for material changes, give reasonable notice. Continued use of the Service after changes means you accept the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to its conflict-of-law provisions. Disputes will be resolved in the courts located in [Nagaon], India, unless your local consumer-protection law gives you the right to bring claims elsewhere.

14. Severability

If any part of these Terms is found unenforceable, the rest remains in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
